Public Records Request
Effective December 17, 2025
Copies of public records are available to the public during normal business hours and charges are outlined in the fee schedule below as permitted by Florida Statute. Florida Statute 119.011(1) defines public records to include all materials, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency. Public records law does not require that an agency create records, give out information from their records, answer questions about their records, perform gratuitous research, reclassify their records into the manner requested, or produce records in a format other than that in which they are maintained.
Exemptions
All such materials, regardless of whether they are in final form, are open for public inspection unless the Legislature has exempted them from disclosure. Some exemptions from disclosure are:
- Active criminal investigative and intelligence information - FSS 119.071 (2)(c)
- Autopsy records - FSS 406.135 (2)
- Bank Account #'s, Debit, Charge and Credit Card #'s held by an agency - FSS 119.071 (5)(b)
- Biometric Identification Information (Fingerprints, Palm Prints, and Footprints) - FSS 119.071 (5)(b)
- Confessions - FSS 119.071 (2)(e)
- Confidential informants - FSS 119.071 (2)(f)
- Criminal history information - FSS 943.052 (2)
- Some Juvenile offender records - FSS 985.04
- Some domestic violence information - FSS 119.071 (2)(j)
- Some victim information - Marsy's Law - Florida Constitution, Article 1, Section 16 (b)(5)
- Surveillance/ investigative techniques - FSS 119.071 (2)(d)
- Mental Health and medical records - FSS 395.3025 (4), (7), & (8) HIPPA / Federal Law

Requests
Public Records Requests can be made in one of the following ways:

Records Service Fees
The Indian River County Sheriff’s Office treats all cases equally. As permitted by law, the Indian River County Sheriff’s Office does not waive costs.

| Incident Reports If you are a victim listed in the report, you must appear in person with your ID to receive an unredacted report. If you are not in Indian River County, you must go to the nearest law enforcement agency to send proof of identification. |

| Large Volume / Bulk Requests for Public Records / Photos Your deposit will be credited to the full value of the invoice. A $200.00 deposit is required. After the $200 deposit is received, a quote will be provided for the total cost of the request. If the total cost of the request is less than $200, the remaining deposit amount will be refunded to you when the request is filled. If the total cost of the request is more than $200, we will process your request when the fee is paid in full. Please note that if a deposit is not received within 15 days, we will consider your request withdrawn. |

| Body Worn Camera (BWC) If camera footage is available for your request, a $100.00 deposit is required. After the $100 deposit is received, a quote will be provided for the total cost of the request. If the total cost of the request is less than $100, the remaining deposit amount will be refunded to you when the request is filled. If the total cost of the request is more than $100, we will process your request when the fee is paid in full. Please note that if a deposit is not received within 15 days, we will consider your request withdrawn. The labor fee will be charged at the hourly rate of the employee fulfilling the request. |

- Please note that in addition to the fees stated above, and pursuant to FSS 119.07(4) (d), a special service charge may apply if the nature or the volume of the records request requires extensive use of information technology resources or supervisory assistance. This charge will be based on the hourly rate of the person completing the request and billed in increments of quarterly hours. It is at the Sheriff’s discretion to charge Law Enforcement Agencies and other government entities for public records.
- A charge of up to $1.00 per copy may be assessed for a certified copy of public records, pursuant to FSS Section 119.07(4)(c).
- Please be advised that our credit card merchant imposes a convenience fee of 3.95% (with a $2.50 minimum) each transaction. Visa, Mastercard, Discover, or American Express accepted.
